The Critical First 24 Hours After a Car Accident in Florida

6 min read June 2025 By RNC Legal Attorneys

The first 24 hours after a car accident are the most critical window for protecting both your health and your legal rights. During this time, evidence disappears, injuries evolve, and insurers begin building their defense. Here is exactly what to do — hour by hour.

At the Scene (First 30 Minutes)

Safety First

Move your vehicle out of traffic if possible and if it is safe to do so. Turn on your hazard lights. If you cannot move the vehicle, get yourself and passengers to a safe area away from oncoming traffic. Set up warning triangles or flares if you have them.

Call 911

Report the accident and request medical assistance even if you don't believe anyone is seriously injured. The 911 call creates a timestamp, and the responding officer will prepare an official crash report. This is one of the most important documents in your claim.

Do Not Admit Fault

Even saying "I'm sorry" or "I didn't see you" can be used against you. Florida's modified comparative negligence law means anything you say can be used to assign you a percentage of blame — reducing or eliminating your recovery. Stick to exchanging information.

Document Everything

Photograph the vehicles, the scene, skid marks, damage, street signs, and traffic controls. Take a video walkthrough. Get the names, phone numbers, and insurance information of all parties and witnesses.

Within the First Few Hours

Seek Medical Evaluation

Even if you feel fine, go to the emergency room or urgent care. Florida's PIP law requires you to seek care within 14 days of the accident, but waiting reduces your benefit: if the provider determines your condition is not an "emergency medical condition," PIP pays only $2,500 instead of $10,000. Go immediately to preserve the full benefit — and your health.

Notify Your Insurance Company

Call your insurer to report the accident. Florida insurance policies typically require prompt notice. Provide only the basic facts: date, time, location, and the other party's information. Do not give a recorded statement yet.

Preserve Evidence From Your Vehicle

Before your vehicle is repaired or towed to a storage yard where it may be moved or cleared, document all damage thoroughly. If your car has an event data recorder (EDR / "black box"), an attorney can subpoena this data — but it must be preserved quickly.

Within 24 Hours

Contact a Florida Car Accident Attorney

Call an attorney as soon as possible. Surveillance video from nearby businesses may be overwritten within 24 to 72 hours. Witness memories fade. The other party's insurer is already conducting its own investigation. An attorney from RNC Legal can send spoliation letters to preserve critical evidence, identify all parties who may be liable, and begin building your case immediately.

Start Your Recovery Journal

Write down everything: your symptoms, pain levels (1-10), what activities you can no longer do, sleep disruptions, and emotional distress. This daily log is powerful evidence of the impact on your quality of life.

Follow All Medical Instructions

Attend every appointment, fill every prescription, and follow your doctor's treatment plan. Any gap in treatment is used by insurers to argue your injuries healed or were not serious. Consistent medical care protects both your health and your claim.
